exista esta política criminal contra mi pueblo, seguirán
existiendo hombres como nosotros, como elemental medida
de autodefensa.
Alegato
presentado en la vista de sentencia celebrada el 13 de diciembre
del 2001 por el compañero Ramón Labañino
Salazar
Your
Honor, Ladys and Gentlemen:
Primero
que todo, yo me uno a todos los argumentos de mis cuatro
hermanos en esta causa y mis reconocimientos al profesionalismo
de los oficiales de esta Corte: Richard, Translators, Marshalls,
Lisa.
El
criminal ataque a las Torres Gemelas de New York y al Pentágono
en Washington segó la vida de miles de inocentes
del pueblo de Estados Unidos, y con indignación nos
unimos al dolor del pueblo norteamericano. Hacemos votos
porque tales hechos no vuelvan a ocurrir.
Nosotros,
que hemos dedicado nuestras vidas a luchar contra el terrorismo,
a evitar que actos tan atroces como estos ocurran; que hemos
tratado de salvar la vida de seres humanos inocentes no
solo de Cuba sino del propio Estados Unidos; hoy estamos
aquí en esta Sala para que se nos condene precisamente
por evitar actos como estos. ¡Esta condena no puede ser
más irónica e injusta!
En
las propias palabras del presidente George W. Bush de este
país, a nombre del cual hoy se me pretende condenar,
se expresan claramente las razones por las cuales vinimos
a Estados Unidos y hoy estamos en esta Sala.
Desde
esta misma ciudad de Miami se ha planificado, organizado
y dirigido el terrorismo contra mi país, Cuba. Desde
aquí se patrocina a los terroristas y sus actos,
se les alienta y financia, se les da albergue (solo por
mencionar un reconocido caso, por las calles de Miami camina
libremente un terrorista y asesino no solo de cubanos sino
del pueblo de Estados Unidos, Orlando Bosch); y lo más
penoso de todo es que esto sucede con el conocimiento y
la anuencia de las autoridades de este país. Baste
con leer detenidamente toda la evidencia de nuestro caso,
que es plena en todo este tipo de acciones terroristas.
Cuba,
mi país, ha sufrido por más de 42 años
actos terroristas, agresiones, invasiones y provocaciones
que han traído la muerte de más de 3 478 seres
humanos inocentes y más de 2 099 heridos. Cuba, al
igual que Estados Unidos, tiene derecho a defenderse.
Solo
por citar algunos ejemplos:
El
4 de marzo de 1960, en un muelle del Puerto de La Habana,
agentes de la CIA hicieron explotar el buque francés
"La Coubre", cuyo sabotaje terrorista asesinó a 101
personas, de ellas seis marinos franceses.
El
6 de octubre de 1976 un artero atentado terrorista perpetrado
por Luis Posada Carriles, Orlando Bosch, y el uso de mercenarios
venezolanos, hicieron detonar dos sendas bombas en pleno
vuelo de un avión civil de Cubana de Aviación
que salía de Barbados, asesinando vilmente a 73 personas
(57 cubanos donde se incluyen 24 jóvenes y niños
del Equipo Nacional de Esgrima de Cuba, 11 jóvenes
de Guyana y cinco coreanos). Algunos de estos asesinos terroristas
están hoy presos en Panamá, y desde esta ciudad
de Miami se hacen esfuerzos enormes para liberarlos, aquí
ellos les llaman "patriotas" y son sus símbolos,
y desde las estaciones de radio se hacen colectas para su
defensa y posible escape de la cárcel.
Contra
el Presidente de Cuba, Fidel Castro, se han realizado 637
intentos de asesinato.
Contra
mi país también se ha practicado el terrorismo
bacteriológico sobre seres humanos, plantas y animales
que han afectado a 344 203 personas, 158 muertos (de ellos
101 niños).

Estos
grupos terroristas sobre los cuales nosotros actuamos, no
solo han provocado tales hechos en Cuba sino aquí
en Estados Unidos, y en este reporte de prensa, totalmente
público y al alcance de todos, se detalla un resumen
de actividades terroristas cometidas aquí en Miami,
en total más de 68 actos de violencia. Este artículo
escrito por el periodista Jim Mullin, del Miami New Times,
en abril 20-26 del 2000, describe entre otros muchos:
1968
Orlando Bosch dispara una bazooka contra un barco polaco
en el puente Macarthur Causeway (Más tarde políticos
de Miami declaran "El día de Orlando Bosch" para
dar honra a tal terrorista).
1974
El líder exiliado José Elías de la
Torriente fue asesinado en Coral Gables por haber fracasado
en una invasión que llevaría a Cuba.
1975
Luciano Nieves es asesinado después de defender la
coexistencia pacífica con Cuba.
1976
Un carro bomba le arranca las piernas al director de noticias
Emilio Milán de la WQBA-AM, después de condenar
públicamente la violencia del exilio.
1981
Explota una bomba en el consulado mexicano en Brickell Ave.,
en protesta por sus relaciones con Cuba.
1996
Una bomba explota en el restaurante Centro Vasco de la Pequeña
Habana por protesta ante el concierto de la cantante cubana
Rosita Fornés.
2000
11 de abril, afuera de la casa de los familiares de Elián
González en Miami, el periodista de Radio Scot Piasant
de Obregón, mostró un t-shirt que decía
"envíen el niño a casa. Es un derecho de padre"
, y fue atacado físicamente antes de que llegara
la policía.
Esto
no es en Cuba. Esto es aquí en Estados Unidos, en
Miami, en las ciudades y calles de este país donde
vivimos todos, por donde ustedes caminan cada día,
sus hijos y familiares.
En
la década de 1990 se arreció el terrorismo,
incursiones y provocaciones hacia mi país, hasta
que en 1997 se ejecutara una ola de acciones terroristas
contra hoteles e instalaciones que llevó al asesinato
de un inocente turista italiano: Favio Di Celmo.
¿Cuántas
muertes más de seres humanos inocentes tenemos que
presenciar para que se acabe esta política loca y
absurda hacia Cuba?
¿Cuántas
vidas más de seres humanos hay que esperar que se
pierdan para que el FBI cumpla realmente con su deber y
detenga a los reales criminales y terroristas de su propio
pueblo de Estados Unidos?
¿Es
que acaso esta "lucha contra el terrorismo" es pura retórica?
No,
el sentido común indicaría que no; y es por
eso precisamente que hoy nosotros estamos aquí; porque
no queremos que nada de esto ocurra en Cuba ni en Estados
Unidos, ni en Miami, ni en ninguna parte del mundo. Todo
lo que hemos hecho es eso: tratar de salvar la vida de seres
humanos inocentes, evitando el terrorismo y evitando una
estúpida guerra.
El
patrón que se sigue en los terroristas cubanos que
nosotros conocemos es el mismo: José Basulto fue
reclutado y entrenado por la CIA y usado en su guerra contra
mi país, y aún hoy sigue practicando el terrorismo
y las provocaciones, como los miembros de las organizaciones
FNCA, Alpha 66, Comandos F-4, Partido Unidad Nacional Democrática
(PUND), Cuba Independiente y Democrática (CID), y
tantos otros que se mencionan en nuestra evidencia.
Estos
terroristas representan para Cuba lo que los autores de
los hechos horribles cometidos contra Estados Unidos representan
para este país.
Cuba
nunca ha confiado ni confiará en estos personajes,
y, como Cuba, Estados Unidos tampoco debería confiar
en ellos, ni mucho menos protegerlos. Eso es un grave error
que explicaría en parte por qué fenómenos
como los del 11 de septiembre suceden.
Mi
país ha sufrido por más de 42 años
del terrorismo; hoy sufre Estados Unidos; y si no se erradica
de raíz podría sufrirlo también mañana.
Aquí en Estados Unidos hay más de 800 organizaciones
de índole violenta, este es el país que más
vulnerable es a este tipo de actos criminales. El terrorismo
es el verdadero enemigo de la seguridad nacional de Estados
Unidos. Mantener una actitud de inactividad o indiferencia
o, peor aún, de complicidad y encubrimiento de los
terroristas y el terrorismo es el peor delito que se puede
cometer contra la seguridad nacional de Estados Unidos;
y es eso precisamente lo que está sucediendo en este
caso. Quienes protegen a estos grupos e individuos son los
que realmente ponen en peligro la seguridad nacional de
Estados Unidos.
¡Por
eso, desde esta tribuna yo denuncio a estas organizaciones
policiales de Estados Unidos, que han encubierto y no actúan
contra el terrorismo y los terroristas!
Cuba,
por años, le ha pasado información a diferentes
instancias gubernamentales, hasta el más alto nivel,
de Estados Unidos; información detallada, documentada,
con nombres y apellidos, evidencias contundentes de actos
criminales y asesinos; de todo lo cual nuestra propia evidencia
en este caso es una muestra total. Y con toda esa información
en sus manos no se ha hecho nada, ni un solo arresto, ni
siquiera una sola investigación que se haya llevado
o lleve a cabo.
Con
nuestra detención todo lo que se ha pretendido es
silenciar la fuente de la información, para que actos
terroristas tan graves no se conozcan, y ocultar esta verdad
que hoy nos golpea de manera brutal. Así también
el FBI se ha confabulado con los mismos terroristas y el
ala derecha extremista de Miami para perjudicar y obstaculizar
todo tipo de acercamiento y cooperación entre nuestros
dos pueblos y gobiernos. Mientras tanto, los criminales
están alegremente recorriendo hoy día las
calles allá afuera, burlándose de esta Sala.
No puede haber una mayor ofensa y mancha para estas autoridades,
para esta bandera que preside este local y ese escudo que
representa el ideal de la verdadera justicia.
Cuba
todo lo que desea es vivir en paz y tranquilidad, no quiere
la guerra, como tampoco la quiere el pueblo de Estados Unidos,
ni líderes militares de Estados Unidos, que saben
muy bien que Cuba no es un peligro en manera alguna para
este país. Por eso es que nuestra labor también
ha estado dirigida a evitar una criminal guerra que solo
traerá muertes de seres humanos inocentes, no solo
de Cuba sino del pueblo de Estados Unidos.
En
ningún momento hemos buscado información que
ponga en peligro la seguridad nacional de este país.
Es una total manipulación, que nunca aceptaremos,
y una razón por la cual decidimos ir a este juicio,
además de exponer claramente esta verdad de todos
los actos criminales que desde territorio norteamericano
se lleva contra Cuba y el propio Estados Unidos.
No
es Cuba la que ha venido aquí a Estados Unidos a
invadir, agredir o cometer actos terroristas de todo tipo,
es todo lo contrario, y Cuba tiene simplemente el elemental
derecho de defenderse; y es eso todo lo que hemos hecho,
sin dañar a nadie ni a nada.
Mientras
exista esta política criminal contra mi pueblo, seguirán
existiendo hombres como nosotros, como elemental medida
de autodefensa. Tal como hoy día Estados Unidos necesita
de manera urgente conocer dentro de las organizaciones terroristas
que lo atacan. Esa es una realidad que nadie podrá
detener.
Todo
lo que buscan los miembros de la extrema derecha de Miami
es crear un conflicto mediante alguna provocación
que termine en una agresión militar de Estados Unidos
a Cuba, y, como ya he dicho, eso no lo deseamos ni mi pueblo,
ni mi gobierno, ni el pueblo de Estados Unidos. El mismo
testimonio del General Sheehan, como consecuencia de las
prácticas de infiltración en Cuba que estaba
llevando a cabo Ramón Saúl Sánchez
con su organización "Democracia", expresó
que no deseaba que estos elementos provocaran una guerra
con Cuba, donde pueden morir muchos jóvenes del ejército
de Estados Unidos y como él varios fueron los ejemplos
que se expusieron en esta Sala.
De
parte de la Fiscalía hemos visto actos realmente
vergonzosos y reprochables que nada tienen que ver con la
justicia y la búsqueda de la verdad: ellos primero
trataron de ocultar toda nuestra evidencia sobre los actos
terroristas llevados a cabo tanto en Cuba como aquí
en Estados Unidos. Trataron por todos los medios posibles
de ocultar el 90 por ciento de nuestra evidencia en este
caso, al cual iba dirigido nuestra tarea principal.
Los
fiscales han manipulado y tergiversado los hechos, han tratado
de controlar en todo momento esta Sala, incluso han utilizado
amenazas sutiles y otras más abiertas. Incluso aquí
se llegó hasta a chantajear a testigos bajo la amenaza
de incriminarlos judicialmente si no se acogían a
la 5ta. Enmienda. Aquí se llegó incluso al
punto de querer chantajear al General de 4 estrellas Charles
Whilhem, ex jefe del Comando Sur, para evitar que declarara
a nombre de la Defensa.
Aquí
se ha tratado de ocultar evidencia (vídeo de 8 mm
cuando Al Alonso, agente del FBI, evitó entregar
el original a la Defensa, cuya prueba era clave en el cargo
más serio de este caso).
Para
nosotros, los fiscales no representan al gobierno de Estados
Unidos, por lo que para nosotros este no es un caso del
gobierno de Estados Unidos versus Gerardo Hernández.
Los fiscales a quienes han representado, y muy bien, es
al pequeño sector extremista de derecha cubano, a
terroristas como José Basulto y a organizaciones
como Alpha 66, FNCA, Comandos F-4, con quienes incluso se
abrazaban y besaban aquí mismo en esta propia Sala
y ante los ojos de todos. Si algo me ha asombrado de este
juicio es el afán enorme, el esfuerzo sin límites
que los fiscales y sus asesores de todo tipo llevaron a
cabo para representar fielmente y a toda costa a este criminal
sector.
Sin
embargo, del otro lado, de parte de la Defensa, se ha mostrado
la verdad, la dignidad, e incluso la posición verdadera
del pueblo de Estados Unidos hacia Cuba. Fue la Defensa
quien trajo a generales, militares y civiles que llevaban
a cabo esta política hacia mi país, tales
como:

Almirante
Atkinson
Coronel
Eugene Carol
Coronel
Buckner
Ex
asesor del presidente de Estados Unidos, Wiliam Clinton
para asuntos de Cuba: Richard Nuccio. Y muchos de ellos
lo hicieron de manera totalmente voluntaria, y en ese pequeño
detalle hay un inmenso mensaje para todos aquellos que sepan
comprender.
Señores:
es tiempo de grandes cambios, estamos ya en pleno siglo
XXI. Hoy Estados Unidos tiene relaciones con China. Tiene
relaciones con Viet Nam, donde murieron 56 000 ciudadanos
de este país. Tiene conversaciones con Corea del
Norte y con muchos otros países con los cuales parecía
imposible tener relaciones.
¿Por
qué con Cuba no?
Es
cierto que para llevar a cabo nuestras tareas, por necesidad
hemos tenido que usar métodos no convencionales;
por razones obvias de poder actuar con seguridad, pero nunca
con el interés de hacer daño a nadie, ni defraudar
o engañar, mucho menos al gobierno o instituciones
de este país.
La
evidencia es sumamente clara en todo aspecto; júzguesenos
por ella. Desde el primer día de este juicio reconocimos
nuestras identidades y responsabilidades, pero nunca acepté
ni aceptaré ninguna implicación de espionaje,
ni de querer defraudar a este país.
Quiero
agradecer especialmente la labor de nuestros abogados, por
su valor y profesionalidad. Para nosotros, y para todos,
este juicio lo hemos ganado nosotros. La historia se encargará
de rectificar este veredicto, y quizás también
esta sentencia.
Señores
fiscales, les guste o no, Cuba es un país independiente
y soberano, tiene su propio gobierno legítimo, su
propio Presidente, sus mártires y héroes,
y sus propias convicciones. Cuba es igual que Estados Unidos.
¡A Cuba, señores, hay que respetarla!
Comprendemos
los esfuerzos que se hicieron por lograr un juicio imparcial;
pero la ciudad de Miami no es lugar para lograr tales propósitos
cuando se trata de Cuba. He ahí, posiblemente, el
error más crítico en nuestro caso: realizar
el juicio en esta ciudad.
¡Si
por evitar la muerte de seres humanos inocentes, si por
defender a nuestros dos países del terrorismo, y
evitar una invasión inútil a Cuba es por lo
que se me condena hoy, pues bienvenida sea!
¡Llevaré
el uniforme de recluso con el mismo honor y orgullo con
que un soldado lleva sus más preciadas insignias!
¡Este
ha sido un juicio político; y, como tal, nosotros
somos prisioneros políticos!
¡Aquí
está toda la evidencia; y aquí está
escrita la historia: ella será quien nos haga verdadera
justicia!

presented by Ramón Labañino Salazar at the sentencing
hearing held, December 13, 2001.
Your
Honor,
Ladies and gentlemen:
First of all, I join in all of the arguments put forward by
my four brothers in this case and in my recognition of the
professional behavior of the officials in this court: Richard,
the translators, the marshals, and Lisa.
The criminal attacks on the Twin Towers in New York and the
Pentagon in Washington took the lives of thousands of innocent
people in the United States, and we share in the anger and
sorrow of the American people. It is our fervent hope that
such events are never repeated.
We who have devoted our lives to fighting terrorism, to preventing
atrocious acts like these from taking place; we who have tried
to save the lives of innocent human beings not only in Cuba
but in the United States as well, stand in this courtroom
today to be sentenced precisely for preventing similar acts.
Thus, this punishment could not be more ironic and unfair!
The words of George W. Bush, president of this country, in
the name of which I am to be sentenced, clearly express the
reasons why we came to the United States and why we find ourselves
in this courtroom today.
From this very city of Miami, terrorist acts against my country,
Cuba, have been planned, organized and directed. From here,
the terrorists and their activities are sponsored, encouraged
and financed. They are given shelter here as well. To mention
just one well-known case, a terrorist and murderer not only
of Cubans but of people from the United States as well, Orlando
Bosch, freely walks the streets of Miami. And what is most
regrettable of all is that all of this takes place with the
knowledge and consent of this country’s authorities.
One need only thoroughly read all of the evidence in our case,
which gives a full account of all these kinds of terrorist
activities.
Cuba, my country, has suffered more than 42 years of terrorist
acts, aggression, invasions and provocations, which have resulted
in the deaths of over 3,478 innocent human beings and physical
injuries to over 2,099. Cuba, like the United States, has
the right to defend itself.
To offer just a few examples:
On March 4, 1960, the French ship La Coubre was blown up in
the port of Havana by agents of the CIA; 101 people were killed
as a result of this terrorist sabotage, including six French
sailors.
On October 6, 1976, in a treacherous terrorist attack perpetrated
by Luis Posada Carriles and Orlando Bosch, through Venezuelan
mercenaries, two bombs were detonated on a Cubana Airlines
civilian aircraft that had taken off from Barbados, cruelly
killing 73 people (57 Cubans, including 24 youths from the
Cuban National Fencing Team, 11 young people from Guyana,
and five Koreans). Some of these terrorist murderers are in
prison today in Panama, and enormous efforts are being made
here in Miami to have them set free. Here they are called
"patriots" and regarded as symbols; radio stations
are raising funds for their defense and possible escape from
jail.
There have been 637 attempts on the life of the president
of Cuba, Fidel Castro.
Bacteriological terrorism aimed at humans, plants and animals
has also been used against my country, with a total of 344,203
people affected and 158 dead, of whom 101 were children.
This is not paranoia, these are lives of innocent human beings!
These terrorist groups we were acting against not only carried
out these kinds of activities in Cuba, but also here in the
United States. This news report, which is totally public and
available to everyone, provides a summary of the terrorist
acts committed here in Miami, a total of over 68 acts of violence.
This article written by journalist Jim Mullin of the Miami
New Times on April 20-26, 2000, among many other incidents,
reports the following:
1968: Orlando Bosch fires a bazooka from the MacArthur Causeway
against a Polish ship (Miami politicians would later declare
an "Orlando Bosch Day" to honor this terrorist).
1974: Exile leader José Elías de la Torriente
is murdered in Coral Gables for the failure of an invasion
he was to lead to Cuba.
1975 Luciano Nieves is murdered after defending peaceful coexistence
with Cuba.
1976: Emilio Milán, the news director at WQBA-AM, has
his legs blown off by a car bomb after publicly condemning
the violence perpetrated by the exile community.
1981: A bomb explodes in the Mexican consulate on Brickell
Ave., in protest over Mexico’s relations with Cuba.
1996: A bomb explodes in the Little Havana restaurant Centro
Vasco, to protest a scheduled concert by Cuban singer Rosita
Fornés.
2000: On April 11, outside the home of Elián González’
relatives in Miami, radio journalist Scott Piasant de Obregón
holds up a T-shirt reading "Send the boy home, it’s
a father’s right," and is physically attacked before
the police arrive.
These things did not happen in Cuba. They happened here in
the United States, in Miami, in the cities and streets of
this country where we all live, where you and your children
and families walk every day.
In the 1990s, terrorism, raids and provocations against my
country were stepped up, until in 1997 there was a wave of
terrorist acts against hotels and other tourism establishments
that resulted in the murder of an innocent Italian tourist,
Favio Di Celmo.
How many more deaths of innocent human beings must we witness
before this insane and absurd policy towards Cuba is ended?
How many more human lives must be lost before the FBI truly
fulfills its duty and arrests the real criminals and terrorists
who act against the very people of the United States?
Could it be that this "fight against terrorism"
is pure rhetoric?
No, common sense would say that it is not. And that is precisely
why we are here today, because we do not want any of these
things to happen, in Cuba, in the United States, in Miami,
or in any other part of the world. All that we have done is
this: to try to save the lives of innocent human beings, by
preventing terrorism and preventing a stupid war.
The same pattern can be observed in all of the Cuban-American
terrorists we know. José Basulto was recruited and
trained by the CIA and used in its war against my country,
and he has kept up the practice of terrorism and provocation
until today, just like the members of such organizations as
the Cuban American National Foundation, Alpha 66, Comandos
F-4, the Democratic National Unity Party (PUND), Independent
and Democratic Cuba (CID), and the many others referred to
in our evidence. These terrorists represent to Cuba what the
perpetrators of the horrific acts committed against the United
States represent to this country.
Cuba has never trusted these characters, and it never will.
Nor should the United States trust them, much less protect
them. This is a serious mistake, which could explain in part
why events like those of September 11 happen.
My country has suffered from terrorism for more than 42 years.
Today the United States is suffering, and if this problem
is not eradicated at the root, it could continue to suffer
tomorrow. Here in the United States there are more than 800
organizations of a violent nature; this country is the one
most vulnerable to these kinds of criminal acts. Terrorism
is the true enemy of the national security of the United States.
Maintaining a stance of inactivity or indifference, or worse
yet, of complicity and concealment of terrorists and terrorism,
is the worst crime that can be committed against the national
security of this nation; and that is precisely what is happening
in this case. Those who protect these groups and individuals
are the ones really endangering the United States’ national
security.
And that is why, from this forum, I denounce the law enforcement
agencies of the United States that have concealed and failed
to take action against terrorism and terrorists!
For many years, Cuba has passed information on to various
government agencies in the United States, up to the highest
level; detailed, documented information, complete with names
and conclusive evidence of criminal acts and murders. Our
own evidence in this case is a full array of that information.
And even with all this information in their hands, they have
done nothing. There has not been a single arrest, or even
a single investigation carried out or underway.
With our arrest, all they have attempted to do is to silence
the source of information, to keep serious acts of terrorism
like these from disclosure and to hide the truth that so brutally
hits us today. Moreover, the FBI has conspired with the terrorists
themselves and the extreme right wing in Miami to damage and
obstruct any kind of rapprochement and cooperation between
our two peoples and governments. Meanwhile, the criminals
are happily walking the streets outside here today, laughing
at this courtroom. There cannot be a greater offense or stain
on these authorities, on the flag presiding this courtroom,
and on that seal representing the ideal of true justice.
All that Cuba wants is to live in peace and tranquility. It
does not want a war, just as the people of the United States
do not want a war. The military leaders of the United States
do not want it either, because they know very well that Cuba
poses no danger whatsoever to this country. That is why our
work has also been aimed at preventing a criminal war, which
would only lead to the deaths of innocent people, not only
from Cuba, but also from the United States.
At no time have we sought out information that could place
the national security of this country in danger. This is pure
manipulation, which we will never accept, and a reason for
which we decided to come to this trial, in addition to clearly
exposing the truth about all of the criminal acts perpetrated
from U.S. territory against Cuba and the United States itself.
It is not Cuba that has come to the United States for the
purpose of an invasion, aggression, or terrorist acts of all
kinds. The reality is the complete opposite, and quite simply,
Cuba has the basic right to defend itself. That is all that
we have done, without causing harm to anyone or anything.
As
long as this criminal policy against my people persists, there
will continue to be men like us, as a basic measure of self-defense,
just as the United States urgently needs to learn about the
inner workings of the terrorist organizations attacking it
today. This is a reality that no one can bring to an end.
What the members of the Miami extreme right are really seeking
is to create a conflict through some sort of provocation that
will result in a U.S. military attack against Cuba. And as
I have said, this is not what my people, or my government,
or the people of the United States want. General Sheehan’s
testimony regarding the infiltrations into Cuba by Ramón
Saúl Sánchez and his "Democracy" group,
revealed that he did not want these elements to provoke a
war with Cuba, which could cost the lives of many young men
in the U.S. armed forces. Numerous similar points of view
were expressed in this courtroom.
As for the prosecution, we have seen a truly shameful and
reprehensible behavior that has nothing to do with justice
and the search for truth. They first tried to suppress all
of our evidence on the terrorist acts perpetrated both in
Cuba and here in the United States. They used every means
possible to try to suppress 90% of our evidence in this case,
that is, the truth about our mission here.
The prosecutors have manipulated and distorted the facts.
They have tried to control this courtroom at all times. They
have used both subtle and blatant threats. They have resorted
to blackmailing witnesses under the threat of legally incriminating
them if they did not plead the Fifth Amendment. They even
went so far as to try to blackmail four-star General Charles
Whilhem, former chief of the Southern Command, to stop him
from testifying for the defense.
There have been attempts to conceal evidence (an 8mm video,
when FBI agent Al Alonso prevented the original from being
turned over to the defense; this was a key piece of evidence
for the most serious charge in this case).
For us, the prosecutors do not represent the government of
the United States, and that is why for us, this is not a case
of the Government of the United States vs. Gerardo Hernández.
Actually, the prosecution has very skillfully represented
the small extremist right-wing sector of the Cuban community,
terrorists like José Basulto and organizations like
Alpha 66, the Cuban American National Foundation and Comandos
F-4. They even went so far as to embrace and kiss these individuals
right in this courtroom, in full view of everyone here. If
something about this trial astonished me, it was the tremendous
zeal, the unlimited efforts made by the prosecution and all
their advisors to faithfully represent this criminal sector,
at any cost.
However, the defense has shown the truth, dignity and the
real stance of the American people towards Cuba. It was the
defense that brought in generals and other military personnel
and civilians who have contributed to carrying out this policy
towards my country, such as: General Charles Whilhem; Admiral
Atkinson; Colonel Eugene Carol; Colonel Buckner; Richard Nuccio,
former advisor to U.S. President William Clinton on Cuban
affairs. Many of them appeared on a fully voluntary basis,
and in this small detail lies a very big message for those
willing to understand it.
Ladies and gentlemen: this is a time of major changes; we
are in the 21st century. Today the United States has relations
with China. It has relations with Viet Nam, where 56,000 citizens
of this country died. It is taking part in talks with North
Korea, and many other countries with which it seemed impossible
to have relations. Why not with Cuba?
It is true that to carry out our tasks, we needed to resort
to unconventional methods. We have done so for obvious reasons
of personal security, and never with the intent of harming
anyone, or cheating or deceiving anyone, much less the government
or institutions of this country.
The evidence is overwhelmingly clear in all respects, judge
ufs based on it! From the very first day of this trial, we
acknowledged our true identities and our responsibilities,
but I never accepted, and never will accept, any implication
of espionage, or of trying to deceive this country.
I want to express special thanks for the work of our attorneys,
for their courage and professionalism. For us, and for everyone,
we have won this trial. History will rectify this verdict,
and perhaps this sentence as well.
Gentlemen of the prosecution, whether you like it or not,
Cuba is an independent and sovereign country. It has its own
legitimate government, its own president, its own martyrs
and heroes, and its own convictions. Cuba is not different
from the United States. And, gentlemen, Cuba must be respected!
We know that efforts were made to ensure an impartial trial.
But the city of Miami is not a place where goals like these
can be achieved when it comes to Cuba. Perhaps that was the
most critical error in our case: holding the trial in this
city.
If preventing the deaths of innocent human beings, defending
our two countries from terrorism, and preventing a senseless
invasion of Cuba are the reasons I am being sentenced today,
then I welcome that sentence!
I will wear the prison uniform with the same honor and pride
with which a soldier wearhis most prized insignias!
This has been a political trial and therefore we are political
prisoners!
All of the evidence is here; this is where history is written.
And it is history that will do us true justice!
